Definitions
In this document the following words and expressions shall have the
following meanings:
*AndorraTaxis* shall refer to the company supplying
the service.
*Client* shall be the person that makes the booking
for themselves or on behalf of other persons.
*Party* shall refer to all persons travelling under
one single booking.
*Passenger* shall refer to a person within a party.
Booking Administration
* The Client accepts these Terms and Conditions on behalf of each
member of the party.
* It is the responsibility of the Client to ensure that all the
information on their AndorraTaxis documents is correct. AndorraTaxis
accepts no responsibility for misinformation given by the Client that
results in either a flight being missed or a driver failing to be at
the collection point to pick up a passenger(s).
* Where a booking is made by telephone, the booking is subject
to, and the Client accepts the Terms and Conditions that are present
on the AndorraTaxis website at the time of booking.
* Any changes to the details of the confirmed booking, including
number of passengers, flight times, destination address, airport etc.
may affect AndorraTaxis ability to provide the transfer and therefore,
AndorraTaxis reserves the right to cancel the original booking if any
such changes cannot be incorporated into the existing transfer schedule
in which case the cancellation policy will apply (see below). The Client
may have to make a new booking with the correct time and date, together
with payment of the applicable tariff.
* Any such changes must be notified to AndorraTaxis as soon as
possible.
* It is the responsibility of the Client to provide a full and
valid mobile telephone number, including the international dialling
code. If the Client does not have a valid mobile telephone number they
must ensure that a resort contact number has been provided. If it is
not possible to provide either of the aforementioned, it is the Client's
responsibility to contact AndorraTaxis on the number shown on the invoice.
Failure to do any of this may cause the Party to miss their transfer,
and as such AndorraTaxis will not be held responsible for any costs
incurred as a result.
* It is the responsibility of the Client to check for messages
left on the nominated mobile telephone number during the day prior to
travel. Notification of any pick-up time changes will be by calling
the nominated mobile contact number.
Missed, Delayed or Cancelled Flights
* In the case of missed, delayed or cancelled flights the Client
must contact AndorraTaxis immediately on 0034 639 503 220.
* If as the result of a missed, delayed or cancelled flight the
Client will not arrive in time for the transfer booked with AndorraTaxis,
the said transfer is deemed to have been missed, and no refund will
be provided.
* AndorraTaxis will endeavour to provide a new transfer where possible.
* If a driver is able to wait, a waiting fee will be charged for
any delays exceeding one hour, which is €30 per hour or part thereof
and must be settled prior to the vehicle's departure.
* If a driver is unable to wait, the Client may either be required
to wait until the completion of other booking obligations or entirely
new transfer arrangements will be made.
* In some circumstances these new transfer arrangements will attract
a further charge, although it may be waived at the discretion of AndorraTaxis
management. Therefore Passengers are advised to check the terms of their
travel insurance policy.
* AndorraTaxis will notify the Client in advance of any further
charges.
* AndorraTaxis, where applicable, will provide a written statement
for the Passenger's travel insurance provider, stating the reason why
the Passenger(s) were unable to travel with AndorraTaxis.
* The Client reserves the right to refuse the new transfer arrangements
and organise an alternative transfer themselves, which signals the end
of their contract with AndorraTaxis.
* AndorraTaxis reserve the right to change pick up times and will
inform the Client by telephone call.
* AndorraTaxis schedule all departures to arrive at airports two
hours before the scheduled departure time of a flight. Should the Client
request a pickup time that is later than the time recommended by AndorraTaxis,
AndorraTaxis accepts no responsibility for any costs incurred due to
missing a flight or onward connection.
Unforeseen Circumstances
* AndorraTaxis will endeavour to carry the Passenger with the minimum
discomfort and inconvenience to the destination shown on the confirmation
documents.
* AndorraTaxis will not accept liability for costs or damages incurred
in the event of a delay due to causes beyond its control. Costs of missed
flights or trains etc. should be claimed from the Passenger's travel
insurance company. Therefore, Passengers are advised to check the terms
of their travel insurance policy.
* The following are examples of circumstances which are not within
the control of AndorraTaxis, but the list is by no means exhaustible:
1. accidents causing delays to the vehicle
2. circumstances affecting passenger safety
3. compliance with requests of the police or government official
4. exceptional or severe weather conditions
5. industrial action by third parties
6. mechanical breakdown
7. problems caused by other clients
8. unforeseen traffic delays
9. vandalism and terrorism
* In the case of extremely adverse weather conditions, AndorraTaxis
may be forced to explore other transport options for the Party. This
will only arise when there is a substantial risk to the Party and driver
involved in attempting the journey and this decision will rest solely
with the AndorraTaxis management. Payment for any extra transport taken
will be borne by the Client; however AndorraTaxis will provide a written
statement for the Client to provide their travel insurance provider.
* In the event that AndorraTaxis is unable to reach the Party for
the pickup time due to bad weather/road conditions, the Party must attempt
to make their own way to a suitable and safe pickup point. AndorraTaxis
will assist with advice in this matter if necessary and will try to
give the Party advance warning whenever possible.
* Force Majeure (war, civil unrest, terrorism, acts of god, etc)
- If affected by any of these situations or other unforeseen events
AndorraTaxis will make every effort to deliver the Party to their destination.
* Road or tunnel closures forcing alternative routes - Where AndorraTaxis
is able to continue to provide the transfer, a supplement is to be agreed
(at the time of transfer or prior where possible) with the Client and
paid on arrival in cash by the Passenger if the Client has not previously
agreed to pay the supplement. The amount of the supplement will reflect
the extra distance, time and tolls involved to transport the Passenger
to their booked destination. Where no agreement can be reached on the
supplement to be paid, or where AndorraTaxis is unable to provide the
transfer on the alternative route (for example to due to other obligations,
or limits on driver hours) AndorraTaxis will transport the Passenger
up to the point at which the normal route is blocked.
* Transport may be provided in a vehicle which does not provide the
same standard of comfort as advertised. This will only occur due to
unforeseen circumstances and AndorraTaxis will not be held liable for
any costs involved. Alternative transport could be in the form of a
taxi or other transfer company vehicles.
Cancellation
* AndorraTaxis undertakes to provide the transfer as booked. A booking
will only be cancelled due to circumstances beyond the control of AndorraTaxis.
* AndorraTaxis reserves the right to cancel the booking at any time
if it feels it will be unable to supply the service requested in the
correct manner.
* Failure of the Party to be at the agreed place at the agreed time
may result in the transfer being cancelled, in which case the Client
is not entitled to a refund. Similarly, AndorraTaxis will not be held
responsible for any subsequent costs incurred under these circumstances.
* Cancellation of a booking must be made in writing, either by post
or by email.
* Cancellations must be made at least 1 week before the time of travel.
* If the Client cancels the booking in writing more than 28 days before
travel AndorraTaxis will refund 75% of the amount paid.
* If the Client cancels within 28 days of travel the full payment will
be forfeited and retained by AndorraTaxis.
* The above payment conditions do not apply in circumstances where AndorraTaxis
has to cancel the booking due to causes beyond its control, or at its
absolute discretion, agrees to cancel the booking.
* Full acceptance of AndorraTaxis price for the service requested is
assumed at the time of booking.
* AndorraTaxis will confirm cancellations by email including a cancellation
reference.
* AndorraTaxis will issue a statement of cancellation upon request,
showing amounts paid by the Client, which the Client may then present
to their travel insurance provider.
Luggage
* All Passengers are limited to two items of luggage including a ski
or snowboard bag. If any Passenger has excess luggage or baggage that
is unreasonably large (e.g. very large combined board and luggage bags),
the Client must advise AndorraTaxis at the time of booking.
* In the event of a Passenger having excess luggage or baggage that
is unreasonably large without having given prior notice, AndorraTaxis
reserves the right to either charge an excess baggage allowance, whilst
potentially carrying them on racks on the outside of the vehicle, or
to not transport the items at all.
* The Client should notify AndorraTaxis at the time of booking, if the
Party will be carrying more than 4 boards/pairs of skis.
* Whilst AndorraTaxis will take all reasonable care in loading and the
carriage of luggage, Passengers' property is carried entirely at their
own risk and AndorraTaxis accepts no responsibility for loss or damage.
Therefore, Passengers are advised to check the terms of their travel
insurance.
Smoking, Alcohol
& Eating
* Smoking and the consumption of alcohol or other illegal substances
are strictly forbidden whilst travelling in any AndorraTaxis vehicles.
* The consumption of food is not permitted in any AndorraTaxis vehicles.
* AndorraTaxis reserves the right (and delegates to its drivers the
right) to refuse to carry any Passenger who is thought to be under the
influence of alcohol or other illegal substances and/or whose behaviour
is considered to pose a threat to the driver, the vehicle or any other
Passenger.
* AndorraTaxis reserve the right to charge the Client for any damage
caused to the vehicle by the Client or their Party. This includes any
exceptional internal cleaning that may be required, which will be charged
at a flat rate of 100€ and is payable immediately to the driver.
AndorraTaxis will provide the Client with a receipt for this transaction.
General
* Seat belts must be worn by all Passengers in all vehicles which are
equipped accordingly. Passengers who choose not to wear their seat belts
will not be covered by AndorraTaxis insurance should the vehicle be
involved in an accident.
* In case of accident, the liability of AndorraTaxis is limited to the
conditions of its insurance contract.
Changes to contractual terms
* AndorraTaxis may alter these terms and conditions from time to time
and post the new version on the AndorraTaxis website, following which
all bookings will be governed by that version. The Client must check
the terms and conditions on the website regularly. The terms governing
the purchase of a transfer will be the terms in place at the time of
the booking.
Complaints, disputes
* Any complaints or service issues should be addressed to AndorraTaxis
in writing by email. AndorraTaxis will endeavour to resolve all service
issues and respond to all complaints within 14 days of receipt.
* Any dispute between AndorraTaxis and a third party, if not resolved
by mutual agreement shall be referred to a mediator. However, if mediation
is unsuccessful, then the matter of the dispute will be referred to
a formal litigation process through the Andorran courts.
Applicable law
* Nothing can affect the consumers' statutory rights.
* AndorraTaxis shall only be liable for any reasonable and foreseeable
consequential losses arising directly out of a breach in contract.
* AndorraTaxis Terms and conditions are governed by Andorran Law.
